NOTICE FOR PUBLIC HEARING

 

CONCERNING AN APPLICATION FOR MINOR VARIANCE FROM ZONING BY-LAW #2016-088  UNDER SECTION 45 OF THE PLANNING ACT, 1990

 

TAKE NOTICE THAT THE COMMITTEE OF ADJUSTMENT FOR MINOR VARIANCE WILL HOLD A HYBRID PUBLIC MEETING ON

 

September 22, 2026 at 10:00 a.m.

This meeting will be held in a Hybrid format in accordance with Section 238 of the Municipal Act, and the Town’s Procedure By-law, which provide for Electronic Participation.

 EXPLANATION OF THE PURPOSE AND EFFECT OF THE PROPOSED MINOR VARIANCE

The minor variance application was submitted in order to reconstruct a dwelling and recognize the location of a shed and a dock.


Specifically, the applicants are requesting relief from Section 4.8 iii) c. of Comprehensive Zoning By-law 2016-088 in order to permit a height increase of a dwelling from 3.84 metres (12.60 feet) to 5.39 metres (17.68 feet), whereas the Zoning By-law does not permit a height increase of a legal non complying building or structure.


The applicants are also requesting relief from Section 4.3.3 of Comprehensive Zoning By-law 2016-088 in order to permit a shed with a side yard setback of 1.22 metres (4.00 feet) in the Shoreline Residential Type 1 (SR1) zone, whereas the Zoning By-law requires a side yard setback of 4.50 metres (14.76 feet).
The applicants are also requesting relief from Section 4.2.1 iii) of Comprehensive Zoning By-law 2016-088 in order to permit a shed with a 17.97 metre (58.96 feet) setback from the high water mark in the Shoreline Residential Type 1 (SR1) zone, whereas the Zoning By-law requires a 20.00 metre (65.60 feet) setback from the high water mark.


The applicants are also requesting relief from Section 4.4.1 iii) a. of Comprehensive Zoning By-law 2016-088 in order to permit a dock with a side yard setback of 1.50 metres (4.92 feet), whereas the Zoning By-law requires a 5.00 metre (16.40 feet) side yard setback.

 EXPLANATION OF THE PURPOSE AND EFFECT OF THE PROPOSED MINOR VARIANCE

The minor variance application was submitted in order to construct an addition to a cottage, a deck attached to a cottage, and to permit an increased total occupied portion of the shoreline.


Specifically, the applicants are requesting relief from Section 3.3.3.1 of Comprehensive Zoning By-law 2016-088 in order to permit a dwelling with a 17.6 metre (57.7 foot) setback from the high water mark in the Shoreline Residential Type 2 (SR2) zone, whereas the Zoning By-law requires a setback of 30.0 metres (98.4 feet) from the high water mark.


The applicants are also requesting relief from Section 3.3.3.1 of Comprehensive Zoning By-law 2016-088 in order to permit a deck with a 15.0 metre (49.2 foot) setback from the high water mark in the Shoreline Residential Type 2 (SR2) zone, whereas the Zoning By-law requires a setback of 30.0 metres (98.4 feet) from the high water mark.


The applicants are also requesting relief from Section 3.3.3.1 of Comprehensive Zoning By-law 2016-088 in order to permit a dryland boathouse with an 8.5metre (27.9 foot) side yard setback, whereas the Zoning By-law requires a setback of 9.0 metres (29.5 feet) from the side yard.


The applicants are also requesting relief from Section 4.4.3 of Comprehensive Zoning By-law 2016-088 in order to permit a total occupied portion of the shoreline of 41%, whereas the Zoning By-law permits a maximum of 25%.

 EXPLANATION OF THE PURPOSE AND EFFECT OF THE PROPOSED MINOR VARIANCE

The minor variance application was submitted in order to construct a deck and recognize the setback of existing structures.


Specifically, the applicants are requesting relief from Section 3.3.3.1 of Comprehensive Zoning By-law 2016-088 in order to permit a dwelling with a 15.27 metre (50.10 foot) setback from the centreline of the road, whereas the Zoning By-law requires a minimum setback of 17.50 metres (57.41 feet) from the centreline of the road.


The applicants are also requesting relief from Section 3.3.3.1 of Comprehensive Zoning By-law 2016-088 in order to permit a covered deck attached to a dwelling the Shoreline Residential Type 1 (SR1) zone with a 15.85 metre (52.00 foot) setback from the highwater mark, whereas the Zoning By-law requires a minimum setback of 20.00 metres (65.62 feet) from the highwater mark.


The applicant is also requesting relief from Section 4.2.1 iii) of Comprehensive Zoning By-law 2016-088 in order to permit a sleeping cabin in the front yard, whereas the Zoning By-law does not permit a sleeping cabin in the front yard.


The applicant is also requesting relief from Section 4.21.1 of Comprehensive Zoning By-law 2016-088 in order to permit a sleeping cabin in the front yard with a 14.63 metre (52.00 foot) setback from the highwater mark, whereas the Zoning By-law requires a minimum setback of 20.00 metres (65.62 feet) from the highwater mark.


The applicants are also requesting relief from Section 4.3.3 ii) of Comprehensive Zoning By-law 2016-088 in order to permit a shed with a 11.46 metre (37.60 foot) setback from the centreline of the road, whereas the Zoning By-law requires a minimum setback of 17.50 metres (57.41 feet) from the centreline of the road.


The applicants are also requesting relief from Section 4.3.3 i) of Comprehensive Zoning By-law 2016-088 in order to permit an accessory structure with a 15.50 metre (50.85 foot) setback from the centreline of the road, whereas the Zoning By-law requires a minimum setback of 17.50 metres (57.41 feet) from the centreline of the road.

 EXPLANATION OF THE PURPOSE AND EFFECT OF THE PROPOSED MINOR VARIANCE

The minor variance application was submitted in order to reconstruct a dock and boathouse.
Specifically, the applicants are requesting relief from Section 4.4.1 i) of Comprehensive Zoning By-law 2016-088 in order to permit a single storey boathouse on a lot with a 18.57 metre (60.93 foot) frontage in the Shoreline Residential Type 1 (SR1) zone, whereas the Zoning By-law requires a frontage of 30 metres (98.43 feet).


The applicants are also requesting relief from Section 4.4.1 iii) a) of Comprehensive Zoning By-law 2016-088 in order to permit a dock with a 1.83 metre (6.00 foot) setback from the side lot line, whereas the Zoning By-law requires a minimum setback of 5.00 metres (16.40 feet).


The applicants are also requesting relief from Section 4.4.1 iii) e) of Comprehensive Zoning By-law 2016-088 in order to permit a boathouse with a 2.74 metre (8.99 foot) setback from the side lot line, whereas the Zoning By-law requires a minimum setback of 9.00 metres (29.53 feet).


The applicants are also requesting relief from Section 4.4.3 of Comprehensive Zoning By-law 2016-088 in order to permit a total occupied portion of the shoreline of 44.7% of the lot frontage or 8.31 metres (27.26 feet), whereas the Zoning By-law permits a maximum occupied portion of 25% of the lot frontage or 4.65 metres (15.26 feet).


The applicants are also requesting relief from Section 3.3.3.1 of Comprehensive Zoning By-law 2016-088 in order to permit a porch attached to a dwelling with a 2.90 metre (9.51 foot) setback from the side lot line, whereas the Zoning By-law requires a minimum setback of 4.50 metres (14.76 feet).


The applicants are also requesting relief from Section 3.3.3.1 of Comprehensive Zoning By-law 2016-088 in order to permit a deck attached to a dwelling with a 0.09 metre (0.30 foot) setback from the side lot line, whereas the Zoning By-law requires a minimum setback of 4.50 metres (14.76 feet).

A Notice of this application has been circulated to all property owners within 60 metres (200 feet) of the subject property and to the appropriate persons and public bodies according to Ontario Regulation 200/96 under the Planning Act.

A copy of the decision of the Committee will be sent to the applicant and to each person who appeared in person or by counsel at the hearing or who filed with the Secretary-Treasurer a written request for notice of the decision.

Please note:  The Committee of Adjustment is a judicial body which makes decisions solely on information gathered as a Committee.  Committee members are not to be contacted prior to the Hearing Date to avoid conflicts of interest.

If you wish to be notified of the decision in respect of this application, you must submit a written request to the Town of Bracebridge (planning@bracebridge.ca). This will also entitle you to be advised of a possible Ontario Land Tribunal Hearing. Members of the public are no longer able to appeal minor variance decisions to the Ontario Land Tribunal, as a result of changes made to the Planning Act by Bill 23 on November 28, 2022.


Take notice that an appeal to the Ontario Land Tribunal in respect to this minor variance application may be made by the applicant, the Minister or a specified person or public body as defined by the Planning Act that has an interest in the matter by filing a notice of appeal with the Secretary-Treasurer either via the Ontario Land Tribunal e-file service (first-time users will need to register for a My Ontario Account) at https://olt.gov.on.ca/e-file-service by selecting Bracebridge (Town of) as the Approval Authority or by mail to the Planning and Development Department, Town of Bracebridge, 1000 Taylor Court, Bracebridge, ON, P1L 1R6 no later than 4:00 p.m. on 20 days from the date the Committee makes a decision. The filing of an appeal after 4:00 p.m., in person or electronically, will be deemed to have been received the next business day. The appeal fee of $1,100 can be paid online through e-file or by certified cheque/money order to the Minister of Finance, Province of Ontario. If you wish to appeal to the Ontario Land Tribunal (OLT) or request a fee reduction for an appeal, forms are available from the OLT website at www.olt.gov.on.ca. If the e-file portal is down, you can submit your appeal to planning@bracebridge.ca.
