NOTICE OF APPLICATION

FOR CONSENT UNDER SECTION 53 OF THE PLANNING ACT, 1990

AN APPLICATION considered to be complete has been received by the Town of Bracebridge for the property legally described as Lot 31 and part of Lot 32, Concession 13, Draper Ward, Town of Bracebridge, including Part 1 of Plan 35R-27522.

AN EXPLANATION of the Purpose and Effect of the applications, describing the lands to which the applications apply, and a key map showing the location of the lands to which the applications apply, accompanies this notice.

ADDITIONAL INFORMATION relating to the applications can be obtained by contacting the Planning Services Branch of the Planning and Development Department at  planning@bracebridge.ca.  

A Notice of the application has been circulated to all property owners within 60 metres (200 feet) of the subject properties and to the appropriate persons and public bodies according to Ontario Regulation 197/96 under the Planning Act.

PURSUANT TO By-law 2022-100, “Delegated Authority Consents”, where no written objections have been received by the Town of Bracebridge or written objections are received that can be resolved between the objector and the applicants, or otherwise addressed or satisfied by a condition of provisional consent, the Director of Planning of Development will render a decision on the proposed applications.  Where written objections are received by the Town of Bracebridge that cannot be resolved, the applications will be brought forward for consideration by the Committee of Adjustment for Consents with the applicants and any objecting persons being notified of when the applications will be heard by the Committee.

ANY PERSON OR AGENCY may make written submissions to the Town of Bracebridge either in support of or in opposition to the proposed consent by emailing planning@bracebridge.ca.  

A copy of the decision will be sent to the applicants and to each person who filed with the Town a written request for notice of the decision.

A decision on these applications will be made NO EARLIER THAN March 17, 2026 (14 days from date of notice).  Any submissions regarding this application must be made in writing before this date.

CONSENT APPLICATION NO. D10-25/25

RICHARD AND SHARON CAETANO - ROLL NUMBER 4418 050 003 00500

 EXPLANATION OF THE PURPOSE AND EFFECT OF THE CONSENT APPLICATION

An application for consent has been submitted for the lands located at 1550 Peterson Road and legally described as part of Lot 18, Concession 5, Draper Ward, Town of Bracebridge, being Part 2 on Plan 35R-13916. The application was submitted for the purpose of a lot addition in favour of an abutting property located at 1534 Peterson Road, legally described as part of Lot 18, Concession 5, Draper Ward, Town of Bracebridge, being Part 1 on Plan 35R-12594.


The subject lands are approximately 36.9 hectares (91.2 acres) in area, with approximately 112.66 metres (369.6 feet) of frontage on Peterson Road. The proposed lot addition, to be added to 1534 Peterson Road, is 0.81 hectares (2.0 acres) in area with no road frontage.

CONSENT APPLICATION NO. D10-02/26

WALDMERE 2015 LIMITED - ROLL NUMBER 4418 030 009 02466

 EXPLANATION OF THE PURPOSE AND EFFECT OF THE CONSENT APPLICATION

An application for consent has been submitted for the lands legally described as part of Lot 13, Concession 4, Monck South Ward, Town of Bracebridge, being Part Reserve A, Plan 11, Parts 5-7 and part of Part 3 on Plan 35R-26085, Parts 1-5, 18, 19, and 41 on Plan 35R-27145. The application was submitted for the purposes of a lot addition in favour of an abutting property located at 1215 Waldmere Road. The application proposes to preserve any and all existing rights-of-way.


The subject lands are approximately 9,651.8 square metres (2.39 acres) in area with no water frontage, and contain portions of Waldmere Road. The proposed severed lot, to be added to the abutting lot described above, is approximately 2,621.8 square metres (0.65 acres) in area with no water frontage and 60 metres (196.9 feet) of frontage on Waldmere Road. No new lots are proposed to be created.


Consent applications D10-32/24 and D10-35/24 were provisionally approved in 2024 for a lot addition and right-of-way over existing private roads, respectively. Since that time, the configuration of the proposed severed lot to be added to 1215 Waldmere Road has changed, necessitating a new consent application. The provisional right-of-way approval in application D10-35/24 is still valid.

This will also entitle you to be advised of a possible Ontario Land Tribunal Hearing. Members of the public are no longer able to appeal Consent decisions to the Ontario Land Tribunal, as a result of changes made to the Planning Act by Bill 23 on November 28, 2022.

Take notice that an appeal to the Ontario Land Tribunal in respect to this consent application may be made by the applicant, the Minister or a specified person or public body as defined by the Planning Act that has an interest in the matter by filing a notice of appeal with the Secretary-Treasurer either via the Ontario Land Tribunal e-file service (first-time users will need to register for a My Ontario Account) at https://olt.gov.on.ca/e-file-service by selecting Town of Bracebridge as the Approval Authority or by mail to the Planning and Development Department, Town of Bracebridge, 1000 Taylor Court, Bracebridge, ON, P1L 1R6 no later than 4:00 p.m. on the twentieth day after the Notice of Decision has been issued. The filing of an appeal after 4:00 p.m., in person or electronically, will be deemed to have been received the next business day. The appeal fee of $1,100 can be paid online through efile or by certified cheque/money order to the Minister of Finance, Province of Ontario.
