NOTICE OF APPLICATION

FOR CONSENT UNDER SECTION 53 OF THE PLANNING ACT, 1990

The following applications considered to be complete has been received by the Town of Bracebridge

ADDITIONAL INFORMATION relating to the applications can be obtained by contacting the Planning Services Branch of the Planning and Development Department at  planning@bracebridge.ca.  

A Notice of the application has been circulated to all property owners within 60 metres (200 feet) of the subject properties and to the appropriate persons and public bodies according to Ontario Regulation 197/96 under the Planning Act.

PURSUANT TO By-law 2022-100, “Delegated Authority Consents”, where no written objections have been received by the Town of Bracebridge or written objections are received that can be resolved between the objector and the applicants, or otherwise addressed or satisfied by a condition of provisional consent, the Director of Planning of Development will render a decision on the proposed applications.  Where written objections are received by the Town of Bracebridge that cannot be resolved, the applications will be brought forward for consideration by the Committee of Adjustment for Consents with the applicants and any objecting persons being notified of when the applications will be heard by the Committee.

ANY PERSON OR AGENCY may make written submissions to the Town of Bracebridge either in support of or in opposition to the proposed consent by emailing planning@bracebridge.ca.  

A copy of the decision will be sent to the applicants and to each person who filed with the Town a written request for notice of the decision.

A decision on these applications will be made NO EARLIER THAN September 18, 2026 (14 days from date of notice).  Any submissions regarding this application must be made in writing before this date.

CONSENT APPLICATION NO. D10-10/26

WALDMERE 2015 LTD - ROLL NUMBER 4418 030 009 02443

 EXPLANATION OF THE PURPOSE AND EFFECT OF THE CONSENT APPLICATION

An application for consent has been submitted for the lands containing a portion of Bangor Lodge Road and legally described as Reserve D on Plan 11, Monck South Ward, Town of Bracebridge.  The application was submitted for the purpose of a lot addition to abutting property at 1099 Bangor Lodge Road.   

The subject lands are approximately 481 square metres (0.12 acres) in area and include the westernmost section of Bangor Lodge Road. 

No new lots are proposed to be created as a result of the application.  The approximate lot addition area is 289.55 square metres.

CONSENT APPLICATION NO. D10-11/26

STEVE AND ANNE-MARIE BLINCO - ROLL NUMBER 4418 050 014 00122

 EXPLANATION OF THE PURPOSE AND EFFECT OF THE CONSENT APPLICATION

An application for consent has been submitted for the lands located at 1677 Fraserburg Road and legally described as part of Lot 19, Concession 13, Draper Ward, Town of Bracebridge, being Part 1 of 35R-26845.  The subject lands are approximately 4.04 hectares (10 acres) in area with 113 metres (371 feet) of frontage on Fraserburg Road.  If approved, the application would result in a Hydro easement.

The application proposes to grant a 3.65 metre (12 foot) wide easement, approximately 450 metres (1476 feet) in length, in favour of the benefitting lot at 1691 Fraserburg Road, to facilitate underground hydro infrastructure to serve the benefitting parcel.

CONSENT APPLICATION NO. D10-13/26

PAUL AND LEIGH JUDSON - ROLL NUMBER 4418 040 019 03800

 EXPLANATION OF THE PURPOSE AND EFFECT OF THE CONSENT APPLICATION

An application for consent has been submitted for the lands located at 1923 Muskoka Rd 117 and legally described as part of lot 31, Concession 7, Macaulay Ward, Town of Bracebridge including Part 2 of Plan 35R-24973.  The subject lands are approximately 24.2 hectares (59.8 acres) in area with 249 metres (816.9 feet) of frontage on Muskoka Road 117.  If approved, the application would result in a right-of-way.

The application proposes to grant a 4.5 metre (14.7 foot) wide right-of-way, approximately 388 metres (1272.9 feet) in length, over the subject lands, in favour of the benefitting lot at 1899 Muskoka Rd 117. The right-of-way would be in the location of an existing driveway from Muskoka Road 117 and would terminate at the Original Road Allowance between the subject lands and benefitting lands.  There is an existing agreement with the Town tied to the benefitting lot regarding the use of a portion of the Original Road Allowance for access.

This will also entitle you to be advised of a possible Ontario Land Tribunal Hearing. Members of the public are no longer able to appeal Consent decisions to the Ontario Land Tribunal, as a result of changes made to the Planning Act by Bill 23 on November 28, 2022.

Take notice that an appeal to the Ontario Land Tribunal in respect to this consent application may be made by the applicant, the Minister or a specified person or public body as defined by the Planning Act that has an interest in the matter by filing a notice of appeal with the Secretary-Treasurer either via the Ontario Land Tribunal e-file service (first-time users will need to register for a My Ontario Account) at https://olt.gov.on.ca/e-file-service by selecting Town of Bracebridge as the Approval Authority or by mail to the Planning and Development Department, Town of Bracebridge, 1000 Taylor Court, Bracebridge, ON, P1L 1R6 no later than 4:00 p.m. on the twentieth day after the Notice of Decision has been issued. The filing of an appeal after 4:00 p.m., in person or electronically, will be deemed to have been received the next business day. The appeal fee of $1,100 can be paid online through efile or by certified cheque/money order to the Minister of Finance, Province of Ontario. If you wish to appeal to the Ontario Land Tribunal (OLT) or request a fee reduction for an appeal, forms are available from the OLT website at www.olt.gov.on.ca.
