EXPLANATION OF THE PURPOSE AND EFFECT OF THE PROPOSED MINOR VARIANCE
The minor variance application was submitted in order to reconstruct a dwelling and recognize the location of a shed.
Specifically, the applicants are requesting relief from Section 4.21.4 of Comprehensive Zoning By-law 2016-088 in order to permit a dwelling at a setback of 1.88 metres (6.17 feet) from the top of bank of a slope of 40% or greater, whereas the Zoning By-law requires a minimum setback of 15.0 metres (49.2 feet) from the top of bank of a slope of 40% or greater.
The applicants are also requesting relief from Section 4.2.1 iii) of Comprehensive Zoning By-law 2016.0-088 in order to permit a shed in the front yard in the Shoreline Residential Type One (SR1) zone with a setback of 20.46 metres (67.13 feet) from the high water mark, whereas the Zoning By-law requires accessory structures other than accessory shoreline structures to be located in an interior side yard or rear yard.
The applicants are also requesting relief from Section 3.3.3.1 of Comprehensive Zoning By-law 2016.0-088 in order to permit a shed with an interior side yard setback of 3.13 metres (10.27 feet), whereas the zoning By-law requires a minimum setback of 4.50 metres (14.76 feet).
