NOTICE OF APPLICATION

FOR CONSENT UNDER SECTION 53 OF THE PLANNING ACT, 1990

TWO (2) APPLICATIONS considered to be complete have been received by the Town of Bracebridge for the properties legally described as Lot 5 and part of Lots 6 and 7 on Plan 15, Bracebridge Ward, Town of Bracebridge. 


AN EXPLANATION of the Purpose and Effect of the applications, describing the lands to which the applications apply, and a key map showing the location of the lands to which the applications apply, accompanies this notice.


ADDITIONAL INFORMATION relating to the applications can be obtained by contacting the Planning Services Branch of the Planning and Development Department at  planning@bracebridge.ca.  

A Notice of these applications have been circulated to all property owners within 60 metres (200 feet) of the subject properties and to the appropriate persons and public bodies according to Ontario Regulation 197/96 under the Planning Act.


PURSUANT TO By-law 2022-100, “Delegated Authority Consents”, where no written objections have been received by the Town of Bracebridge or written objections are received that can be resolved between the objector and the applicants, or otherwise addressed or satisfied by a condition of provisional consent, the Director of Planning of Development will render a decision on the proposed applications.  Where written objections are received by the Town of Bracebridge that cannot be resolved, the applications will be brought forward for consideration by the Committee of Adjustment for Consents with the applicants and any objecting persons being notified of when the applications will be heard by the Committee.

ANY PERSON OR AGENCY may make written submissions to the Town of Bracebridge either in support of or in opposition to the proposed consent by emailing planning@bracebridge.ca.  


A copy of the decision will be sent to the applicants and to each person who filed with the Town a written request for notice of the decision.


A decision on these applications will be made NO EARLIER THAN September 9, 2025 (14 days from date of notice).  Any submissions regarding this application must be made in writing before this date.

CONSENT APPLICATION NO. D10-51/24 and D10-20/25

 EXPLANATION OF THE PURPOSE AND EFFECT OF THE CONSENT APPLICATION

Two (2) applications for consent have been submitted for the lands located at 11 Bird Lane and the abutting lot with no civic address assigned, which are legally described as Lot 5 and part of Lots 6 and 7 on Plan 15, Macaulay Ward, Town of Bracebridge. The applications were submitted for the purpose of reciprocal lot additions.  As noted on the key plan, the subject lands for application D10-20/25 reflect the lot configuration that will exist once provisionally approved consent application D10-01/23 has been finalized and a portion of the lot has been added to the abutting lot to the east.


The subject lands in application D10-51/24 are approximately 947 square metres (0.23 acres) in area with 37.4 metres (122.6 feet) of frontage on Bird Lane and 21.3 metres (69.9 feet) of frontage on the inner limit of the original shore road allowance (OSRA) abutting the Muskoka River.  The proposed severed lot, to be added to Lot 5 of Plan 15, is approximately 45.1 square metres (485 square feet) in area with 8.5 metres (28.0 feet) of frontage on Bird Lane and no OSRA or water frontage.  The resultant retained lot would be 902.0 square metres (0.22 acres) in area with approximately 28.8 metres (94.6 feet) of frontage on Bird Lane and 21.3 metres (69.9 feet) of frontage on the OSRA abutting the Muskoka River.  


The subject lands in application D10-20/25 are approximately 1,059.9 square metres (0.26 acres) in area with 20.0 metres (65.5 feet) of frontage on Bird Lane and 38.6 metres (126.8 feet) of frontage on the OSRA.  The proposed severed lot, to be added to part of Lots 6 and 7 of Plan 15, is approximately 27.8 square metres (300.0 square feet) in area with no road frontage and 16.4 metres (53.9 feet) of frontage on the OSRA.  The resultant retained lot would be 1,032.1 square metres (0.26 acres) in area with approximately 20.0 metres (65.5 feet) of frontage on Bird Land and 37.7 metres (123.8 feet) of frontage on the OSRA.


The resultant lots after the completion of both lot additions would have the following sizes:

  • 11 Bird Lane, being part of Lots 6 and 7 on Plan 15, Macaulay Ward, Town of Bracebridge would be 929.8 square metres (0.23 acres) in area with 28.8 metres (94.6 feet) of frontage on Bird Lane and 37.7 metres (123.8 feet) of frontage on the OSRA; and
  • No civic address, being Lot 5 on Plan 15, Macaulay Ward, Town of Bracebridge would be 1,077.1 square metres (0.27 acres) in area with 28.5 metres (93.5 feet) of frontage on Bird Lane and 22.3 metres (73.0 feet) of frontage on the OSRA.

If you wish to be notified of the decisions in respect of this application, you must submit a written request to the Town of Bracebridge (planning@bracebridge.ca). This will also entitle you to be advised of a possible Ontario Land Tribunal Hearing. Members of the public are no longer able to appeal Consent decisions to the Ontario Land Tribunal, as a result of changes made to the Planning Act by Bill 23 on November 28, 2022.


Take notice that an appeal to the Ontario Land Tribunal in respect to this consent application may be made by the applicant, the Minister or a specified person or public body as defined by the Planning Act that has an interest in the matter by filing a notice of appeal with the Secretary-Treasurer either via the Ontario Land Tribunal e-file service (first-time users will need to register for a My Ontario Account) at https://olt.gov.on.ca/e-file-service by selecting Town of Bracebridge as the Approval Authority or by mail to the Planning and Development Department, Town of Bracebridge, 1000 Taylor Court, Bracebridge, ON, P1L 1R6 no later than 4:00 p.m. on the twentieth day after the Notice of Decision has been issued. The filing of an appeal after 4:00 p.m., in person or electronically, will be deemed to have been received the next business day. The appeal fee of $1,100 can be paid online through efile or by certified cheque/money order to the Minister of Finance, Province of Ontario. If you wish to appeal to the Ontario Land Tribunal (OLT) or request a fee reduction for an appeal, forms are available from the OLT website at www.olt.gov.on.ca. If the e-file portal is down, you can submit your appeal to planning@bracebridge.ca.
