NOTICE OF APPLICATION

FOR CONSENT UNDER SECTION 53 OF THE PLANNING ACT, 1990

AN APPLICATION considered to be complete has been received by the Town of Bracebridge for the property legally described as part of Lot 6, Concession 6, Draper Ward, Town of Bracebridge, being Part 3 of 35R-19694.

AN EXPLANATION of the Purpose and Effect of the application, describing the lands to which the application applies, and a key map showing the location of the lands to which the application applies, accompanies this notice.

ADDITIONAL INFORMATION relating to the application can be obtained by contacting the Planning Services Branch of the Planning and Development Department at planning@bracebridge.ca. A Notice of this application has been circulated to all property owners within 60 metres (200 feet) of the 
subject properties and to the appropriate persons and public bodies according to Ontario Regulation 197/96 under the Planning Act.

PURSUANT TO By-law 2022-100, “Delegated Authority Consents”, where no written objections have been received by the Town of Bracebridge or written objections are received that can be resolved between the objector and the applicant, or otherwise addressed or satisfied by a condition of provisional consent, the Director of Planning of Development will render a decision on the proposed 
application. Where written objections are received by the Town of Bracebridge that cannot be resolved, the application will be brought forward for consideration by the Committee of Adjustment for Consents with the applicant and any objecting persons being notified of when the application will be heard by the Committee.

ANY PERSON OR AGENCY may make written submissions to the Town of Bracebridge either in support of or in opposition to the proposed consent by emailing planning@bracebridge.ca.

A copy of the decision will be sent to the applicant and to each person who filed with the Town a 
written request for notice of the decision.

A decision on this application will be made NO EARLIER THAN May 29, 2025 (14 days from date of notice). Any submissions regarding this application must be made in writing before this date.

CONSENT APPLICATION NO. D10-07/25

JILL AND DAVID STICKEL - ROLL NUMBER 4418 050 002 071 00

 EXPLANATION OF THE PURPOSE AND EFFECT OF THE CONSENT APPLICATION

An application for consent has been submitted for the lands located at 1169 Germania Road and legally described as part of Lot 6, Concession 6, Draper Ward, Town of Bracebridge, being Part 3 of 35R-19694. The subject lands are approximately 6.64 hectares (16.42 acres) in area with 167.6 metres (550 feet) of frontage on Germania Road. If approved, the application would result in a Hydro easement.
The subject property has received provisional consent approval for one severed and one retained lot in Application D10-52/24. Application D10-07/25 proposes to grant a 3 metre (9.8 foot) wide easement, approximately 80 square metres (861 square feet) in area, over the provisionally approved severed lot in favour of the provisionally approved retained lot, to recognize existing underground hydro and communication cables that serve the provisionally approved retained parcel.

CHARLES AND NANCY MAHONEY - ROLL NUMBER 4418 050 004 004 00 

 EXPLANATION OF THE PURPOSE AND EFFECT OF THE CONSENT APPLICATION

An application for consent has been submitted for the lot located at 1047, 1061 and 1063 Mahoney Lane and legally described as Lot 27, Concession 4, Draper Ward, and part of Lots 27 and 28, Concession 5, Draper Ward, Town of Bracebridge. The subject lands are approximately 109 hectares (269 acres) in area with 302 metres (988 feet) of frontage on Prospect Lake Road, 250 metres (820 feet) of frontage on Mahoney Lane, and 877 metres (2,877 feet) of frontage on Stone Gate Lane. The subject lands also have approximately 437 metres (1,434 feet) of split frontage on Prospect Lake.
If approved, the application proposes to grant a 6.1 metre (20 foot) wide right-of-way, being approximately 0.2 ha (0.5 acres) in area, in favour of nearby lands legally described as Lot 29, Concession 4, part of Lot 28 Concession 4 and part of Lots 29 and 30, Concession 5, Draper Ward, Town of Bracebridge.

If you wish to be notified of the decisions in respect of this application, you must submit a written request to the Town of Bracebridge (planning@bracebridge.ca). This will also entitle you to be advised of a possible Ontario Land Tribunal Hearing. Members of the public are no longer able to appeal Consent decisions to the Ontario Land Tribunal, as a result of changes made to the Planning Act by Bill 23 on November 28, 2022.


Take notice that an appeal to the Ontario Land Tribunal in respect to this consent application may be made by the applicant, the Minister or a specified person or public body as defined by the Planning Act that has an interest in the matter by filing a notice of appeal with the Secretary-Treasurer either via the Ontario Land Tribunal e-file service (first-time users will need to register for a My Ontario Account) at https://olt.gov.on.ca/e-file-service by selecting Town of Bracebridge as the Approval Authority or by mail to the Planning and Development Department, Town of Bracebridge, 1000 Taylor Court, Bracebridge, ON, P1L 1R6 no later than 4:00 p.m. on the twentieth day after the Notice of Decision has been issued. The filing of an appeal after 4:00 p.m., in person or electronically, will be deemed to have been received the next business day. The appeal fee of $1,100 can be paid online through efile or by certified cheque/money order to the Minister of Finance, Province of Ontario. If you wish to appeal to the Ontario Land Tribunal (OLT) or request a fee reduction for an appeal, forms are available from the OLT website at www.olt.gov.on.ca. If the e-file portal is down, you can submit your appeal to planning@bracebridge.ca.
