EXPLANATION OF THE PURPOSE AND EFFECT OF THE PROPOSED ZONING BY-LAW:
The zoning amendment proposes to amend the Town of Bracebridge’s Comprehensive Zoning By-law 2016-088 by changing the zoning of the subject lands from the present zone of Residential Type 3 – Holding (R3-H) zone to Office Commercial Special – 9 (C1-9). The intent of the zoning amendment is to allow for permitted uses appropriate for the proposed Ecclestone Drive Mixed Use Area designation through Official Plan Amendment No. 18.
Permitted uses in the Residential Type 3 – Holding (R3-H) zone are only those uses existing at the date of passing of the Comprehensive Zoning By-law 2016-088 until the Holding Symbol is removed by by-law, at which time the permitted uses are all those uses in the R3 zone. The property is currently used as a Retail Store (Ecclestone Cycle) with an accessory dwelling unit. The Holding Symbol may be removed once the developer has entered into a Site Plan Agreement with the Town which includes storm water management plans to be prepared, satisfactory to the Town, and the site plan showing visual barriers in accordance with Zoning By-law requirements.
The proposed Office Commercial Special – 9 (C1-9) zone permitted uses shall be all those uses in the Office Commercial (C1) zone including Artisan Studio, Bed & Breakfast, Convenience Store, Drug Store, Farm Produce Retail Outlet, Fitness Studio, Home Occupation, Hotel, Motel, Open Air Farmer’s Market, Outdoor Display & Sale, Repair Shop, Retail Store, Restaurant, Speciality Food Store, Winery, Duplex Dwelling, Triplex Dwelling and Second Dwelling Unit, subject to the following provisions:
- That the setbacks of the existing single detached dwelling be deemed to comply.
All other applicable provisions of the Office Commercial (C1) zone shall continue to apply with respect to the lands located within the Office Commercial Special – 9 (C1-9) zone.
